Judge Merchan Swiftly Denies Trump’s Request to Delay Sentencing
New York Judge Juan Merchan rejected President-elect Donald Trump’s attempt to postpone sentencing in his high-profile Manhattan criminal case, setting the stage for a dramatic court appearance just days before his planned return to the White House.
The ruling, issued Monday, ensures Trump’s sentencing will proceed as scheduled on January 10, 2025, merely ten days before his inauguration as the 47th president.
Judge Merchan has already indicated that Trump will receive an “unconditional discharge.”
This means no prison time will be imposed for his conviction on 34 counts of falsifying business records, according to Fox News.
TTOA reported Monday that Trump filed a motion to delay his sentencing in the ongoing case.
The move comes as Trump’s legal team challenges the upcoming ruling, citing constitutional grounds and legal precedents.
Trump’s spokesman and incoming White House communications director, Steven Cheung, issued a statement Monday, calling for an immediate halt to what he referred to as a “Witch Hunt” orchestrated by the Manhattan District Attorney’s office.
“Today, President Trump’s legal team moved to stop the unlawful sentencing in the Manhattan D.A.’s Witch Hunt,” Cheung told Fox News.
“The Supreme Court’s historic decision on Immunity, the state constitution of New York, and other established legal precedent mandate that this meritless hoax be immediately dismissed.”
Cheung further characterized the case as a “meritless hoax” that requires immediate dismissal.
“The American People elected President Trump with an overwhelming mandate that demands an immediate end to the political weaponization of our justice system,” Cheung stated, emphasizing the incoming administration’s desire to move past the legal proceedings.
The case stems from Trump’s May conviction related to a $130,000 payment made to former adult film star Stormy Daniels before the 2016 election, per Fox.
Manhattan District Attorney Alvin Bragg’s office successfully argued that Trump falsified business records to conceal the payment, which was intended to suppress Daniels’ claims of a 2006 affair with Trump.
The Manhattan District Attorney’s Office swiftly opposed Trump’s delay request, leading to Judge Merchan’s decisive ruling: “Defendant’s motion for a stay of these proceedings, including the sentencing hearing scheduled for January 10, 2025, is hereby DENIED.”
Trump, maintaining his innocence throughout the proceedings, took to Truth Social to voice his frustration.
“Virtually ever[y] legal scholar and pundit says THERE IS NO (ZERO!) CASE AGAINST ME,” he posted Sunday evening, arguing that the case exemplifies why businesses are leaving New York, “taking with them millions of jobs, and BILLIONS OF DOLLARS IN TAXES.”
The upcoming sentencing creates an unprecedented situation in American history, with a president-elect facing criminal sentencing days before taking the oath of office.
