Texas Lawmaker Introduces Bill to Criminalize ‘Gender Identity Fraud’

A Texas lawmaker is taking new steps to regulate “gender identity” policies, proposing a bill that would make it a felony to misrepresent biological sex on official documents.

The legislation, introduced by Rep. Tom Oliverson (R-Conroe), is part of the state’s broader effort to define gender recognition strictly by biological sex. House Bill 3817 seeks to create a new criminal offense called “gender identity fraud.” 

Under the measure, knowingly providing false gender information to a government agency or employer—if it contradicts biological sex—could result in up to two years in jail and a $10,000 fine.

The bill comes as Texas continues to battle over gender markers on state-issued IDs. Last year, the Texas Department of Public Safety (DPS) implemented a policy barring gender marker changes that do not align with biological sex, according to Just the News. 

The ACLU of Texas strongly opposed the move, calling it “an alarming attack on privacy, safety, and dignity” and part of a broader effort to restrict the rights of trans-identifying individuals.

A legal challenge followed when a judge ordered DPS to allow gender marker changes on state IDs. In response, Texas Attorney General Ken Paxton issued a formal legal opinion last Friday, arguing that Texas courts lack the authority to compel agencies to alter biological sex on government documents.

Paxton ruled that any previous gender marker changes made under such court rulings should be undone.

“State agencies must correct any unlawfully altered driver’s licenses or birth certificates that were changed as a result of non-legally binding judicial orders,” Paxton wrote.

He further argued that judges do not have jurisdiction to override biological reality.


“Radical left-wing judges do not have the authority to order agencies to violate the law,” he wrote. “In Texas, we will follow common sense and restore any documents that were wrongfully changed to be consistent with biology.”

Texas lawmakers have made legally defining gender by biological sex a major legislative priority in recent years. Gov. Greg Abbott (R) has signed multiple laws reinforcing biological distinctions, including measures to ban biological males from competing in women’s sports and prohibit sex change surgeries for minors.

The state legislature is also considering a bill that would restrict restroom and locker room access based on biological sex in state-funded facilities. Abbott has voiced support for the measure and is expected to sign it if it passes both chambers.

Another bill under review seeks to ban “furry subculture” behavior in schools, a measure that has drawn both support and ridicule online, Just the News notes.

Texas’ approach reflects a broader national battle over “gender identity” policies. President Donald Trump has taken a strong stance on the issue, declaring during his joint address to Congress, “There are only two genders: male and female.”

Early in his second term, Trump issued executive orders prohibiting biological males from competing in female sports at both the school and collegiate levels.

Paxton echoed a similar view in his legal opinion, stating, “There are only two sexes, determined not by feelings or ‘gender theory’ but by biology at conception.”
